IMPORTANT: This Service is designed for children aged 7-14. Parental consent and supervision are required for all users under 18 years of age.
2. Services Provided
We provide an interactive, browser-based coding education platform designed specifically for children aged 7-14. Our Service includes:
- Interactive coding projects and tutorials
- AI-powered learning assistance and feedback
- Webcam-based computer vision projects
- Live group classes and AI Mentor sessions
- Progress tracking and achievement badges
- Portfolio building tools
Features and functionalities may evolve, and we reserve the right to modify or discontinue any aspect of the Service at any time with appropriate notice.
3. Age Requirements and Parental Consent
a. Primary Users: Our Service is designed for children aged 7-14 years old.
b. Parental Consent: Parents or legal guardians must provide explicit consent for children under 18 to use our Service.
c. Account Creation: Parents/guardians must create and manage accounts for children under 13, in compliance with COPPA (Children's Online Privacy Protection Act).
d. Supervision: Parents/guardians are responsible for supervising their children's use of the Service and ensuring appropriate online behavior.
e. Account Responsibility: Parents/guardians are responsible for all activities conducted under their child's account.
4. Account Registration and Use
a. Parent/Guardian Accounts: Parents or legal guardians must create accounts for children under 13.
b. Accurate Information: You agree to provide accurate, current, and complete information during registration.
c. Account Security: You are responsible for maintaining the confidentiality of login credentials and monitoring account activity.
d. Appropriate Use: Users agree to use the Service only for educational purposes and in accordance with these Terms.
e. No Unauthorized Access: Users may not attempt to gain unauthorized access to other accounts or the Service's systems.
f. Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms.
5. Subscription, Fees, and Payment
a. Subscription Plans: The Service is provided on a subscription basis with various plans (Free Trial, Creator Path, AI Explorer Path, AI Expert Path).
b. Payment Responsibility: Parents/guardians are responsible for all subscription fees and payments.
c. Refund Policy: Payments are generally non-refundable, except as required by Pennsylvania law or as specified in our refund policy.
d. Auto-Renewal: Subscriptions renew automatically unless canceled at least 30 days before the renewal date.
e. Price Changes: Prices are subject to change with 30 days' prior notice.
f. Taxes: Fees exclude applicable taxes, which are the responsibility of the account holder.
6. Acceptable Use Policy
Users agree not to:
- Use the Service for any unlawful, harmful, or inappropriate activities
- Create, upload, or share content that is harmful, offensive, or inappropriate for children
- Attempt to access other users' accounts or personal information
- Use the Service to harass, bully, or harm other users
- Upload viruses, malware, or other harmful code

7. Content and Safety

c. Moderation: We actively moderate user-generated content and interactions to ensure a safe learning environment.
d. Reporting: Users and parents can report inappropriate content or behavior through our reporting system.
e. Content Removal: We reserve the right to remove any content that violates our policies or is inappropriate for children.
8. Intellectual Property Rights
a. Our Content: All rights, title, and interest in the Service, including trademarks, copyrights, and patents, belong to CodeCreate.
b. User License: Users are granted a limited, non-exclusive, non-transferable license to use the Service for educational purposes.
c. Student Work: Students retain ownership of their original coding projects and creations.
d. Portfolio Use: Students may use their completed projects in portfolios and resumes.
e. Sharing Rights: We may showcase student projects (with permission) for educational and promotional purposes.
9. Data Collection and Privacy
a. COPPA Compliance: We strictly comply with the Children's Online Privacy Protection Act (COPPA).
b. Parental Consent: We require verifiable parental consent before collecting personal information from children under 13.
c. Data Minimization: We collect only the minimum personal information necessary to provide our educational services.
d. Data Security: We implement industry-standard security measures to protect children's personal information.
e. Data Retention: We retain personal information only as long as necessary to provide our services.
f. Privacy Policy: By using the Service, you acknowledge and agree to our Privacy Policy.
10. AI and Educational Tools
a. AI Assistance: Our platform uses AI to provide educational assistance, feedback, and personalized learning experiences.
b. Educational Purpose: AI tools are designed solely for educational purposes and coding instruction.
c. No Guarantees: While we strive for accuracy, AI-generated content and feedback may not always be perfect.
d. Human Oversight: AI interactions are monitored and supervised by human educators.
e. Learning Tool: AI assistance is a learning tool and should not replace critical thinking or parental guidance.
11. Live Classes and AI Mentoring
a. Supervised Sessions: All live classes and AI Mentor sessions are supervised by qualified educators.
b. Recording: Some sessions may be recorded for quality assurance and educational purposes (with appropriate consent).
c. Behavior Standards: Students must follow appropriate behavior standards during live sessions.
d. Parental Access: Parents may request access to recordings of their child's sessions.
e. Session Cancellation: We reserve the right to cancel or reschedule sessions due to technical issues or other circumstances.
12. Termination and Suspension
We reserve the right to terminate or suspend accounts if users:
a. Violate these Terms or our Acceptable Use Policy
b. Fail to pay applicable fees
c. Engage in inappropriate behavior or harassment
d. Provide false information during registration
e. Use the Service for non-educational purposes
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- CodeCreate SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE PAST 12 MONTHS.
- We are not liable for any damages resulting from children's use of the internet or third-party websites accessed through our Service.
14. Indemnification
You agree to indemnify and hold harmless CodeCreate, its officers, employees, and affiliates from any claims, losses, damages, liabilities, and expenses arising from your or your child's use of the Service or violation of these Terms.
15. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict of law principles.
- Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA).
- Users waive their right to participate in class-action lawsuits and jury trials.
16. Modifications to Terms
We may update these Terms at any time. We will provide notice of material changes via email or through our platform. Continued use after posting constitutes acceptance of the updated Terms.
17. Force Majeure
We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, power outages, cyberattacks, government actions).
18. Severability and Waiver
- If any provision is found invalid, the rest remain enforceable.
- Failure to enforce any provision does not waive our rights.
19. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and CodeCreate regarding the Service.
